			<content:encoded><![CDATA[<p>First-time homebuyers comprise a large percentage of sales in the Las Vegas housing market, and claiming their windfall from the federal government has kept tax preparers a little busier than normal in the offseason.</p>
<p>Congress extended the $8,000 credit for first-time homebuyers last month and expanded it to other buyers who can receive up to $6,500.</p>
<p>“We are getting a lot of calls and have done quite a few,” said Roni Kerfien, a tax preparer at <a href="http://www.career-pathway.com/business-leaders/roni-lynn-deutch/">Roni Deutch</a> Tax Center. “We have done a lot of our competitors’ (clients) because for many tax preparers this is their off-season.”</p>
<p>Bernadette Mashas, a tax manager at Fair, Anderson and Langerman, said the expansion of the tax credit Nov. 6 has created some confusion among buyers who have called to seek clarification.</p>
<p>Some existing homeowners who bought a home thought they were eligible for the $6,500 tax credit, but it only applies to those who closed Nov. 6 or later, Mashas said.</p>
<p>To get the credit, buyers need to fill out Internal Revenue Service Form 5405, amend their tax return with Form 1040X and attach the final settlement statement to their return. That is a new requirement under the law, Mashas said. That may prevent some from filing their 2009 tax returns online because there is no procedure to include the settlement statement with the filing, Mashas said.</p>
<p>Filing electronically ensures a prompt payment, but Mashas said that change in the law means that if buyers want to get reimbursed quicker, it’s best to amend their 2008 return.</p>
<p>The tax credit has been extended until April 30 for signing the contract with the purchase required to be completed by June 30, Mashas said. Congress would have to act for the credit to be extended beyond that.</p>
<p>The person has to live in the home for 36 months or must repay the tax credit, Mashas said. It is not that hard to do, but if people are confused or don’t feel they are capable of amending the return, Mashas said they should hire a tax specialist.</p>
<p>That’s what Kerfien suggested that because many people have found it confusing to fill out the amended returns and the IRS will send it back if anything is filled out incorrectly. For some people, it might take three or four times to get it right, Kerfien said. Having an expert can cost $95 to $150, she said.</p>
<p>“It can take a lot longer to get your credit (doing it on your own),” Kerfien said.</p>
<p>Buyers are disappointed to learn they may not qualify for any or only a partial tax credit based on their income, Mashas said.<br />
The limit to receive the full tax credit is $225,000 for married couples, an increase from $155,000 before Nov. 6, she said. Couples who earn $225,000 to $245,000 receive only a partial credit; it’s eliminated after $245,000, she said.</p>
<p>Individuals are allowed to earn up to $125,000, an increase from $75,000, Mashas said. The credit is eliminated after $145,000.</p>

<p>This is an infrequently used legal document in the real estate industry. It is a contract where both parties agree to move the completion date for a project forward (earlier). This could either be a construction project or a remodelling or renovation project. In most cases, there is an additional charge to complete the work earlier and this document is used by a builder to secure the funds. It also protects the buyer because it memorializes the earlier date and should specify concessions should the earlier date not be met.</p>
<p>There are three things to keep in mind when signing such an agreement: (1) Is the scope of the project staying the same? (2) What additional resources, if any, are needed for the earlier completion date? and (3) What happens in the event the earlier date is not met?</p>
<h2>Scope of Work Under an Accelerated Building Agreement</h2>
<p>In some cases, the details of the project remain the same. However, a builder may use this as an opportunity to renegotiate materials, project details or even subcontractor arrangements. This should not be viewed by the buyer as an unscrupulous move. In many cases, changing dates necessitates changing details of the project. The crucial distinction is whether the changes are material or not. For instance, using Formica instead of Granite is a material change that should be mutually agreed upon and specified in the document whereas using a different landscaping company because of scheduling conflicts is immaterial.</p>
<h3>Are Additional Resources Necessary?</h3>
<p>Each party needs to seriously contemplate whether the existing project crew or team can accomplish the work on the shorter timeframe. Simply throwing more resources at the project is probably not a good idea, but this is always an area that warrants discussion ahead of time.</p>
<h3>What Happens if the Date is Missed?</h3>
<p>This is an area that builders typically want to avoid. This is also an area where buyers should stand firm. In almost every instance, accelerating the project will mandate additional costs to the buyer. The buyer should then have some recourse if the project doesn&#8217;t meet the earlier timeframe. There is no standard formula for calculating this amount.</p>

<h2>What Kind of Will Do You Need</h2>

<p>A <a href="http://www.docbuilder.com/living-will/cat_1613.html">Living Will</a> is a legal document that enables an individual to state medical directives and preferences. These documents come into play when someone is unable to communicate their desires (usually in a hospital setting). Typically, the two main areas are artificial respiration (breathing) and cardiopulmonary resuscitation (attempting to keep the heart pumping).</p>
<h3>Living Will Complexity and Living Will Clauses</h3>
<p>It is possible to draft a brief and valid Living Will in just a couple pages. There are other circumstances and special considerations that will extend the scope and complexity to a great many pages. The most common issue confronted while drafting or contemplating a Living Will is the duration of life sustaining treatments. Most people do not want to exist in a <em>persistent vegitative state</em>. However, in some cases, the individual may want all reasonable attempts to be made to sustain their life and only to terminate life sustaining treatments &#8220;when all reasonable hope of recovery&#8221; is lost.</p>
<p>From a drafting perspective, it takes great care to accurately convey the wishes of someone who does not have a straightforward medical directive request. In other cases, individuals attempt to distinguish among the various life saving implementations that may be used. They may want to expressly prohibit such things as feeding tubes or blood transfusions. These requests are more straightforward and usually easier to accomodate. (But special care must be taken to know what types of medical procedures may be implemented and identify them correctly and explicitly in the document.)</p>
<h3>Interpretation of Living Will Language</h3>
<p>Living wills are very specific documents. Almost universally, medical situations are complex and subject o many different opinions. It becomes very difficult to follow the intent of a Living Will when the document is overly complex and lengthy.
