Workers Compensation Retaliation

Most states prohibit an employer from discriminating against employees for filing workers' comp claims. Generally an employer may not fire you in retaliation. Other states also prohibit the employer from taking any action against you, such as a demotion, refusal to transfer or failure to promote. Regardless of what your state law says, public policy usually prohibits an employer from discriminating against you for filing a claim.
